1.   Citation

   This Order may be cited as the Botswana Power Corporation (Vesting of Assets and Liabilities) Order.

2.   Vesting of assets and liabilities

   There is hereby designated-

   (a)   the assets described in the First Schedule; and

   (b)   the liabilities specified in the Second Schedule,

being assets and liabilities of the Government which were part of, concern or relate to the Government Electricity undertakings, as assets and liabilities which were, with effect from 1st January, 1971, with the consent of the Botswana Power Corporation, vested in the said Corporation.

FIRST SCHEDULE
ASSETS

   The electricity undertaking established and operated by the Government under the name or style of "Gaborone Water and Electricity Unit" for the purpose of supplying consumers in the townships of Gaborone and Lobatse, and the area adjacent or intermediate thereto, with electricity generated by a thermal and diesel fuel power station at Gaborone by means of associated transmission and distribution lines, together with all ancillary equipment required for that purpose, office equipment, staff housing and furniture therein, the whole comprising-

   (a)   Lots 1222 and 6044, Gaborone;

   (b)   Lots 4984 and 4987, Gaborone;

   (c)   Lot 531, Lobatse;

   (d)   one KV overhead line constructed of double wood pole structures carrying three phase conductors and two earth wires running from a step-up substation on Lot 1222, Gaborone, to a step-down substation on Lot 1061, Lobatse, as depicted on sheets numbered 2425 DZ, 2425 D3, 2425 D4 and 2525 B1, together with associated substations, equipment, apparatus, meters, cables and switchgear;

   (e)   the 11 000 volt high tension distribution system and 380/220 volt low tension distribution system comprising overhead lines and underground cables supplying consumers in Gaborone and adjacent areas, together with all associated substations, equipment, apparatus, meters, cables and switchgear required for such supply;

   (f)   the 11 000 volt and 3 300 volt overhead high tension distribution system and 380/220 volt overhead low tension distribution system supplying consumers in Lobatse and adjacent areas and at points intermediate between Gaborone and Lobatse, together with all associated substations, equipment, apparatus, meters, cables and switchgear required for such supply; and

   (g)   the contents of offices numbered 5 to 11, Capitol Building, The Mall, Gaborone, the subject of an agreement of lease entered into by the Government with Farhar Properties (Proprietary) Limited on 10th April, 1970, which lease was assigned by Government to the Corporation on 26th March, 1971.
